Please read these terms carefully before using our website or engaging The Hala Design for creative services.

1. Acceptance of Terms

By accessing this website, submitting an inquiry, or engaging The Hala Design ("we," "us," or "our") for creative services, you ("client," "you," or "your") agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, please do not use our website or commission our services. These terms apply to all visitors, clients, and users of our website and services.

2. Services

The Hala Design provides boutique creative design services, including but not limited to digital art, animation, branding, event visual suites, baby announcements, commemorative art, and related design deliverables.

The specific scope, timeline, revisions, and deliverables for any project will be outlined in a written proposal, quote, or project brief agreed upon before work begins. Services not listed in that agreement are outside the project scope and may incur additional fees.

3. Quotes, Deposits & Payments

Quotes and proposals are valid for the period stated in the document (or 30 days if none is stated). Prices are subject to change for work not yet confirmed.

A non-refundable deposit (typically a percentage of the total project fee, as specified in your proposal) is required to reserve a project start date and begin work. Remaining balances are due as outlined in the payment schedule.

Work may be paused if payments are overdue. Final deliverables are released only after full payment is received, unless otherwise agreed in writing.

Late payments may incur reasonable administrative fees or interest as permitted by applicable law.

4. Client Responsibilities

You agree to provide timely feedback, approvals, brand assets, copy, photos, and other materials needed to complete the project.

Delays in providing required materials or feedback may extend project timelines. We are not responsible for missed event dates or deadlines caused by delayed client input.

You confirm that any materials you supply (logos, images, text, music, etc.) are owned by you or properly licensed, and that their use will not infringe third-party rights.

5. Revisions & Change Requests

Projects include the number of revision rounds specified in your proposal. Additional revision rounds or scope changes may be billed at our standard rates.

Major changes to the approved direction, format, or deliverables after work has substantially begun may require a revised quote and adjusted timeline.

6. Intellectual Property

Until full payment is received, all design concepts, drafts, and final files remain the intellectual property of The Hala Design.

Upon full payment, you receive a license to use the final approved deliverables for the purposes stated in the project brief (for example, personal event use, commercial branding, or digital publication), unless a different ownership arrangement is agreed in writing.

We reserve the right to display completed work in our portfolio, website, social media, and marketing materials, unless you request confidentiality in writing before project completion.

Unused concepts, drafts, source files (unless purchased), and our proprietary tools, processes, and design systems remain our property.

7. Cancellations & Refunds

If you cancel a project after work has started, the deposit is non-refundable. You will also be invoiced for work completed beyond the deposit, based on progress and hours invested.

If we cancel a project for reasons within our control (and not due to client breach), we will refund any fees paid for undelivered work, less costs already incurred.

Refunds are not provided for completed and delivered work, or for change-of-mind after final files have been released.

8. Third-Party Services & Platforms

Our website may link to third-party platforms such as WhatsApp, Instagram, or other services. We are not responsible for the content, privacy practices, or availability of those platforms.

If your project involves third-party tools, fonts, stock assets, or software licenses, you may be responsible for purchasing and maintaining those licenses as specified in the project agreement.

9. Website Use

You may browse this website for personal, non-commercial information about our services. You may not scrape, copy, reverse-engineer, or misuse site content, images, or code without our prior written consent.

All website text, imagery, branding, and design elements are protected by copyright and other intellectual property laws. Unauthorized use is prohibited.

10. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis. While we strive for excellence, we do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

Design is inherently subjective. We commit to professional craftsmanship and good-faith collaboration, but we cannot guarantee specific commercial results, engagement metrics, or third-party platform outcomes arising from the use of our deliverables.

11. Limitation of Liability

To the fullest extent permitted by law, The Hala Design shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities.

Our total liability arising out of any project or use of this website shall not exceed the total fees you paid to us for the specific project giving rise to the claim.

Nothing in these terms excludes liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify and hold harmless The Hala Design and its team from claims, damages, and expenses arising from: (a) materials you provided; (b) your use of deliverables beyond the agreed scope; (c) your breach of these terms; or (d) infringement of third-party rights related to content you supplied.

13. Privacy & Communications

When you contact us via forms, WhatsApp, email, or Instagram, we use the information you share to respond to inquiries and deliver services. We do not sell your personal information.

You consent to reasonable project-related communications. You may opt out of non-essential marketing messages by contacting us.

14. Force Majeure

We are not liable for delays or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, illness, internet outages, platform failures, government actions, or other unforeseen events.

15. Governing Law

These Terms and Conditions are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the UAE, unless otherwise required by mandatory local law.

16. Changes to These Terms

We may update these Terms and Conditions from time to time. The “Last updated” date at the top of this page reflects the latest revision. Continued use of our website or services after changes constitutes acceptance of the updated terms.

For active projects, material changes that affect your engagement will be communicated when reasonably practical.
